Terms & Conditions

These Terms & Conditions govern payments made to AcmeExperience Marketing Private Limited (“ACME”) through its website and/or authorised online payment gateway.

1. Nature of Services

ACME is engaged in experiential marketing, event management, brand activations, corporate events, artist management and related professional and event execution services. Services are undertaken based on proposals, estimates, work orders, purchase orders, contracts, email approvals or other mutually agreed commercial arrangements with clients.

2. Online Payments

The online payment facility provided on this website is intended primarily to facilitate payment of amounts due to ACME against approved estimates, invoices, advances, additional services or other mutually agreed commercial commitments. Online payment is an additional payment facility and does not replace the contractual or commercial terms separately agreed between ACME and the client. Payments may be made using eligible domestic or international credit/debit cards or other payment methods supported by the authorised payment gateway.

3. Payment Authorisation

The person making the payment represents that he/she is authorised to use the relevant payment instrument and, where payment is made on behalf of a company or organisation, is authorised to make such payment on its behalf.

4. Transaction Charges and Currency

Payments shall be processed in the currency displayed at the time of payment. Any foreign exchange conversion, international card charges, bank charges or similar charges levied by the card issuer or financial institution shall be governed by the terms of the respective institution.

5. Payment Confirmation

A successful payment transaction does not by itself constitute acceptance of any new or additional scope of work by ACME. The applicable services shall continue to be governed by the relevant proposal, estimate, contract, purchase order, work order or other written commercial agreement between ACME and the client.

6. Failed or Duplicate Transactions

If a transaction fails but an amount is debited from the payer’s account, the transaction will be subject to reconciliation with the payment gateway and banking system. Any confirmed duplicate or excess payment received by ACME will be refunded or adjusted against amounts payable, as mutually agreed.

7. Cancellation and Refund

Cancellation and refund of payments are governed by ACME’s Refund & Cancellation Policy and, where applicable, the specific contractual or commercial terms agreed with the client for the relevant project or event.

8. Limitation

ACME shall not be responsible for transaction failures, delays or interruptions caused by banks, card networks, payment gateways, internet connectivity or other systems outside ACME’s reasonable control.

9. Governing Law

These Terms & Conditions shall be governed by the laws of India. Any dispute relating specifically to online payments made to ACME shall be subject to the jurisdiction of the competent courts in Bengaluru, Karnataka, unless otherwise provided in the applicable contract with the client.
